Respondents PRAYER: Criminal Revision filed under Section 401 of Code of Criminal Procedure to call for the entire records in respect of C.R.P.No.29/2008 on the file of Additional District Cum Sessions (Fast Track) Court, Vellore and set aside the order dated 30.04.2009 and direct the learned Judicial Magistrate Gudiyatham to proceed with the case in C.C.No.269/2007.

ORDER

When the matter was listed on 30.10.2013, this Court has ordered notice to the respondents for the hearing on 13.11.2013, as well as private notice. The learned counsel for the petitioner was directed to file affidavit of service alongwith postal receipt and postal acknowledgment if any, or or before 13.11.2013.

2. But till today notice was not served to the respondent. Since the criminal revision is pending from the year 2013 and the petitioner has not ready to conduct the case, this Court has no other option except to dismiss the same for non prosecution.

3. Hence the Criminal Revision petition is dismissed for non prosecution.
