This Application has been filed to condone the delay of 105 days in filing the above captioned C.M.A against the decree and judgment dated 29.09.2022 made in M.C.O.P.No.202 of 2019 on the file of the Motor Accident Claims Tribunal, Subordinate Judge, Paramathy.
2. Though notice has been served on the first respondent, none appeared in person or through counsel on behalf of the first respondent.
3. Mr.Suresh Srinivasan, learned counsel appearing for the 2nd respondent submitted that he has no serious objections in allowing the above application. 4.Heard both sides.
5.Considering the averments made in the affidavit filed in support of this application and also the fact that 2nd respondent has no serious objections in allowing the present petition and being satisfied with the same, the delay is condoned. Hence, this application is ordered as prayed for.
6.Registry is directed to number the C.M.A., if it is otherwise in order and the list the same in due course.
