This application has been filed seeking leave to the plaintiff to file the above suit against the defendants 3, 4 and 5 and for the items 2,3 and 4 of the suit schedule properties.

2. According to the learned counsel for the applicant / plaintiff, the suit has been filed for partition and declaration in respect of the schedule mentioned properties. Even though the cause of action is well within the jurisdiction of this Court, items 2, 3 and 4 of the suit schedule mentioned properties are situated outside the jurisdiction of this Court and some of the defendants are residing outside the jurisdiction of this Court. Hence, this leave application is filed.

3. Considering the submission made by the learned counsel for the applicant / plaintiff and considering the averments made in this application as well as the plaint, leave is granted. Registry to number the plaint if it is otherwise in order.
