Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of the third respondent in their Ref.No.SRCAPP485/B.Ed(Minority)/TN/2012-13/41804 dated 30.5.2012 and quash the said order and further direct the third respondent to pass necessary fresh orders on the basis of the recommendation to be forwarded to the third respondent by the 1st and 2nd respondents and further direct the 1st and 2nd respondents to forward their recommendation to the third respondent in pursuance to the inspection of the petitioner's college conducted by them through the Zonal Joint Director, Collegiate Education at Coimbatore on 27.9.2011.

O R D E R

The petitioner has approached this Court with the present writ petition, challenging the order dated 30.05.2012, under which, the third respondent has refused and rejected the request of the petitioner for grant of recognition for B.Ed course.

2.However, when the matter was taken up for consideration, the learned counsel for the petitioner, on instructions, submitted that it would suffice, if the petitioner is permitted to submit a fresh representation seeking recognition for B.Ed course and on such submission, the authorities concerned may be directed to consider the same, as per law.

3.The learned counsel appearing for the respective respondents have no serious objection in granting such relief to the petitioner.

4.Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court permits the petitioner to submit a fresh representation enclosing the necessary documents with regard to their claim, to the authorities concerned within a period of two weeks from the date of receipt of a copy of this order. On such submission, the authorities concerned are directed to consider the same and pass appropriate orders, on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner, within a period of six weeks thereafter.

5.Accordingly, this writ petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
