O R D E R

This writ petition has been filed for issue of a writ of mandamus directing the second respondent to register the settlement deed executed by the petitioner in favour of his son.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

3. The grievance of the petitioner is that the second respondent is insisting upon the original title documents and since the same has been misplaced and is not traceable, the settlement deed is not registered.

4. In the considered view of this Court, if the title documents have been misplaced and lost and a publication has been made in the newspaper, a recital in that effect shall be included in the settlement deed. If the same is done, the second respondent shall entertain and register the settlement deed, if it is otherwise in order. 2/4

The Writ Petition is disposed of in the above terms. There shall be no order as to costs.
