Petition filed under Article 226 of The Constitution of India, praying to issue a Writ of Mandamus directing the respondents to provide compensation along with appropriate interest to the petitioners for acquisition of their land to an extent of 1540 square feet or 0081.0 square meter, situated in Survey No.1491/3C1, located at Block No.20, Chengalpattu Village, Chengalpattu Taluk and District, which was given for the purpose of constructing flyover instead of Rail Pass No.1, between Thirumani and Chengalpattu Old Seevaram Railway Stations, within the time limit to be stipulated by this court. ORDER
This writ petition has been filed seeking a writ in the nature of mandamus directing the respondents to provide compensation along with appropriate interest to the petitioners for acquisition of their land to an extent of 1540 square feet or 0081.0 square meter, situated in Survey No.1491/3C1, located at Block No.20, Chengalpattu Village, Chengalpattu Taluk and District, which was given for the purpose of constructing flyover instead of Rail Pass No.1, between Thirumani and Chengalpattu Old Seevaram Railway Stations, within the time limit to be stipulated by this court.
2. The grievance of the petitioners is that till date compensation has not been paid despite the land has been acquired by the State for National Highways way back in 2011 for the purpose of constructing flyover to replace the existing rail pass between Thirumani and Chengalpattu Old Seevaram Railway Stations.
3. Heard both sides.
4. The learned Additional Government Pleader would, on instructions, submit that the petitioners were called for an enquiry on 21.06.2024 and during the enquiry the 2nd petitioner who appeared in person made a statement to the effect that he would receive the compensation only after the orders of this court. A copy of such statement of the 2nd petitioner is also produced for the perusal of the court.
5. The learned counsel appearing for the petitioners would submit that the petitioners would appear before the respondent for award enquiry.
6. Considering the submissions made on either side, the petitioners are
directed to appear before the 1st respondent for award enquiry and 1st respondent is directed to complete the award enquiry as expeditiously as possible and pass final award determining the compensation after following the due procedure and see that the compensation determined is paid to the petitioners as expeditiously as possible.
This writ petition is disposed of accordingly with the above directions. No costs.
