ORDER

This Criminal Original Petition seeks modification of the condition directing the petitioner to deposit a sum of Rs.1,50,000/- to the credit of 1/4

Cr.No.190 of 2024, while granting anticipatory bail by the learned Principal Sessions Judge, Chengalpet vide order dated 12.02.2025 in Crl.MP.No.361 of 2025.

The learned counsel for the petitioner would submit that the condition to deposit is onerous; that the petitioner and the defacto complainant are close relatives; that the entire wrongful loss said to have been caused to the defacto complainant has been directed to be deposited and sought for modification.

The learned Government Advocate (Crl.Side) submitted that the petitioner and the defacto complainant are close relatives; that the petitioner had stolen the jewels of the defacto complainant, and pledged the same; that coming to know the said fact, the defacto complainant paid a sum of Rs.1,50,000/- to redeem the jewels; and that the petitioner promised to pay the said amount and cheated the defacto complainant of the said amount besides, committing the offence of theft and hence, submitted that the condition is justified.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent police and 2/4

perused the materials available on record.

Considering the submissions on either side, this Court is of the view that the condition cannot be set aside. However, this Court is inclined to modify the said condition directing the petitioner to deposit a sum of Rs.1,00,000/- [Rupees One Lakh Only] instead of Rs.1,50,000/- to the credit of Cr.No.190 of 2025. This Court is also inclined to grant four weeks time from today to make the said deposit.
