Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased To stay the operation of the impugned Re-auction Notice issued by the 2nd respondent vide ITMS Code 6167 dated 09/05/2022 (in WMP.No.12619 of 2022) pending disposal of the WP.No.13383 of 2022. Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.R.KANNAN, Advocate for the petitioner and of MR.K.KARTHIKEYAN, Government Advocate (HR & CE) on behalf of the Respondents, the court made the following order:- Learned counsel for the petitioner made a submission that the petitioner is in possession of the subject property. However, learned Government Advocate appearing on behalf of the HR & CE Department made a submission that the petitioner is an encroacher and the subject property is to be auctioned by following the procedures and the notification was already issued.
