PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus to direct the respondents to provide 4% reservation for persons with disability in the promotional post of AE/Electrical Class II Service and consequently to promote the petitioner to the post of AE/Electrical Class II Service.

ORDER

The present wit petition has been filed with a prayer for writ of mandamus to provide 4% reservation for persons with disability in the promotional post of AE/Electrical Class II Service and consequently to promote the petitioner to the post of AE/Electrical Class II Service.

2. The learned counsel appearing on behalf of the petitioner though has originally come up with a prayer for writ of mandamus based upon the representation dated 16.04.2024, it is the submission that the Government has subsequently issued Government Order dated 21.06.2025, clarifying that not withstanding the mode of recruitment even in promotion, differently abled persons are eligible to get 4% and in this connection, the Government has issued G.O.Ms.No.06 dated 21.06.2025.

3. While looking at the typed set of papers, the learned counsel for the petitioner had enclosed the representation of the petitioner dated 16.04.2024.

4. Now, in view of G.O.(Ms).No.06 dated 21.06.2025, there is change in circumstances.

In such view of the matter, without going into the merits of the writ petition, this Court deems it appropriate to direct the petitioner to give a fresh representation to the respondents within a period of two weeks from today (i.e., 03.07.2025) and on receipt of such representation, the respondents are directed to consider the same and pass order according to its own merits and in accordance with law within a period of four (4) weeks thereafter.

6. In view of the above direction, the writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 03.07.2025 ssi Index : Yes Speaking Order : Yes /No To:
