Admittedly, the private complaint is maintainable for the offence under Section 494 of the Indian Penal Code as seen from the averments made in the affidavit filed in support of the Writ Petition and as per the representation given by the petitioner. There is nothing on record to show that the 1st respondent has no jurisdiction to look into the complaint.

2.The Writ Petition is disposed of giving liberty to the petitioner to give a private complaint before the Jurisdictional Magistrate, if so advised. No costs.
