(Order of the Court was made by M.SUNDAR,J.,) Captioned writ petition was disposed of in and by an order dated 27.04.2023, most relevant operative portion is paragraph No.4 and the same reads as follows:

'Mr.R.Muniyapparaj, learned State Additional Public Prosecutor, assisted by Mr.M.Sylvester John, learned counsel who accepts notice for both respondents submits, on instructions, that the request of convict prisoner for 30 days ordinary leave without escort is under active consideration of the respondents and that a decision will be taken as expeditiously as the business of the respondents would permit but in any event within three weeks from today i.e., on or before 18.05.2023.'

2. Dr.S.Manoharan, learned counsel on record for petitioner and Mr.R.Muniyapparaj, learned Additional Public Prosecutor (assisted by learned counsel Mr.M.Sylvester John) for respondents are before us. M.SUNDAR, J.

3. Learned Prosecutor, on instructions, submits that the representation was duly considered and the same has been negatived in and by an order dated 15.05.2023. Learned Prosecutor goes on to add that this is owing to the report of jurisdictional probationary officer but we refrain ourselves from expressing any opinion as we are preserving all the rights and contentions of the petitioner to challenge the order rejecting the petitioner's representation for leave. Compliance is recorded preserving all the rights and contentions of the petitioner or anyone concerned for detenu to challenge the same.
