The applications in Appln.No.119 of 2023 is filed to annul the order of adjudication dated 30.11.2006 passed against the debtor as insolvent in I.P.No.139 of 2006.
2. The application in Appln.No.120 of 2023 is filed to permit the learned Official Assignee to disburse a sum of Rs.2,167/- to the proved unsecured creditors.
3. The application in Appln.No.121 of 2023 is filed to pass an order closing the administration of insolvency proceedings in I.P.No.139 of 2006.
4. The learned Official Assignee would submit that in the present case, the respondent was adjudicated as insolvent vide order dated 30.11.2006 passed in I.P.No.139 of 2006. He would further submit that after adjudication, the insolvent has not been cooperating with the learned Official Assignee. 5. Even after filing of these applications, there is no representation on behalf of the insolvent, which shows that he is not interested to contest this matter.
6. On considering the submission made by the learned Official Assignee and on perusing the materials available on record, this Court is inclined to allow these applications.
7. Accordingly, all these applications are ordered as prayed for. The order of adjudication dated 30.11.2006 is hereby annulled and the learned Official Assignee is permitted to disburse the said amount to the proved unsecured creditors and further, the administration of insolvency proceedings in I.P.No.139 of 2006 is hereby closed. 05.06.2023 nsa Appln.Nos.119 to 121 of 2023 in I.P.No.139 of 2006 https://www.mhc.tn.gov.in/judis Page No.2/2
