Respondents --- PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned communication of results published in the Web Site of the respondent viz. WWW.tnusrbexams.net pertaining to the Petitioner's Enrolment Number 1303211 on the file of the respondents herein, quash the same and consequently direct the respondents herein to consider her Application under "Wards Quota" and permit her to attend the next stage of physical fitness test.

O R D E R

(Made by The Hon'ble The Chief Justice) The petitioner applied for recruitment as Sub Inspector in pursuance to the advertisement issued on 08.02.2015, both under the category of Destitute, being a widow, as also a Ward of a Police Officer, as her father is a retired Police Officer. The entitlement would, thus, be under both the categories and naturally, if in either of the categories the petitioner is eligible, the benefit ought to have been given to the petitioner.

2. The petitioner's case was, however, considered only under the Destitute Category and not under the Ward Quota and thus, did not meet the cut-off marks under the Destitute Category, though would have met it so under the Ward Category. The petitioner also approached this Court on 29.07.2015, three days before the Physical Endurance Test was to commence.

3. In view of the aforesaid, we opine that the case of the petitioner is liable to be considered under the "Ward Quota". This would necessitate a Physical Endurance Test and if she clears the Physical Endurance Test, then viva-voce would be held.

4. The petition is accordingly allowed, leaving the parties to bear their own costs. Consequently, M.P. Nos. 1 and 2 of 2015 are closed.
