Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents to survey the land namely vacant house sites situate in No.13, Vellanur Village comprised in Survey No.340/1H and 1L in the layout named as Shirdi Sai Nagar Annexe and as per patta bearing Nos.1793 and 8143 Survey Nos.340/1H1B and 340/1L1D bearing Plot Nos.2, 3, 16 and 17 measuring a total extent of 7931 sq.feet situated within the limits of Vellanur Village Panchayat within the Registration Sub District of Avadi and Registration District of Tiruvallur and demarcate the same by fixing the boundary stones pursuant of petitioner application dated 24.02.2025. 1/4

O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 2 and 3 to act upon the online application submitted by the petitioner on 24.02.2025 and to survey the subject property and demarcate the boundaries.

2. Heard Mr.A.Saravanan, learned counsel for petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing for respondents.

3. The petitioner is relying upon the sale deed dated 11.06.2022. The petitioner is also relying upon the patta granted in his favour in patta No.10416. The petitioner submitted an application on 24.02.2025 seeking for survey of the subject property and for demarcation of boundaries. Since the same was not acted upon, the present writ petition has been filed.

Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the second respondent to act upon the online application submitted by the petitioner on 24.02.2025 and conduct the survey based on the title document and the patta that stands in the name of the petitioner. This process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. If there are any rival claims, such survey shall be conducted in their presence.

This writ petition is disposed of with the above direction. No costs.
