The present petition has been filed seeking to fix an early date for disposal of the above Habeas Corpus Petition. 2.The learned counsel for the petitioner submitted that the detenu's hand has been deliberately broken by the respondent police and his condition is very worst and no proper treatment has been given by the prison authorities.
3.However, the learned Additional Public Prosecutor filed a report given by the Dean, Government Stanley Hospital, Chennai. From the report it is evident that a surgery viz., Open reduction and internal fixation with bicolumnar plating is to be conducted today i.e., on 18.09.2020 in their hospital viz., Government Stanley Hospital, Chennai. Therefore, proper 1/3
treatment is being given to the detenu and there is no necessity for him to take treatment in private hospital.
4.Hence, based on the health condition of the detenu, there is no necessity for fixing an early date for disposal of the Habeas Corpus Petition. Accordingly, the Criminal Miscellaneous Petition is dismissed. Post the above Habeas Corpus Petition in the usual course. (N.K.K.,J.) (P.V.,J.) 18.09.2020 ay 2/3
