Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus to direct the respondent herein to consider the petitioner representation dated 24.02.2017, and consequently issue Patta in favour of the petitioner, comprised in Survey No.765 (part) of Odhalavadi Village within the period fixed by this Court. O R D E R

Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents.

2. The petitioner seeks for a Mandamus to direct the respondent herein to consider the petitioner representation https://hcservices.ecourts.gov.in/hcservices/

dated 24.02.2017, and consequently issue Patta in favour of the petitioner, comprised in Survey No.765 (part) of Odhalavadi Village.

3. The grievance of the petitioner is that the said representation has not been considered so far. At this stage, this Court is not expressing any view on the merits of the claim made by the petitioner as it is for the 4th respondent to consider and decide the same on merits and in accordance with law. Accordingly, writ petition is disposed of by directing the 4th respondent to to consider the representation of the petitioner dated 24.02.2017 and pass orders on the same on merits and in accordance with law, after hearing the rival claimants, if any. Such exercise shall be done by the 4th respondent within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No costs.
