ORDER
The petitioners apprehends arrest for the alleged offence under Sections 140, 296(b), 115(2), 351(3), 308(4) and 318(4) of the Bharatiya Nyaya Sanhita, 2023 in Crime No.77 of 2026 on the file of the respondent police seek anticipatory bail.
2. The case of the prosecution is that due to certain financial dispute between the petitioners and the de facto complainant, the petitioners intimidated the de facto complainant with dire consequences. Hence, this case.
3. The learned counsel for the petitioners submitted that the petitioner were innocent and that they have been falsely implicated in this case. He further submitted that they are ready to abide by any stringent condition that may be imposed by this Court and they are ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the respondent police is investigating the matter. Hence, he opposed to grant anticipatory bail to the petitioners.
5. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.

Considering the facts and circumstances of the case and the submission made by the learned Government Advocate (Crl.Side) that unless the petitioners are taken under custody for interrogation, the question of identity of the other assailant becomes difficult. The said contention cannot be found faulted.
Taking into consideration of the allegation against the petitioners and the preliminary stage of enquiry, this Court is not inclined to enlarge the petitioners on anticipatory bail.
