ORDER
The petitioner, who apprehends arrest for the alleged offence under Sections 309(4), 61(2) and 49 of BNS and subsequently altered to Sections 311, 61(2), & 49 of BNS corresponding IPC Sections 397, 120-B & 109, in Crime No.56 of 2026, on the file of the respondent police seeks anticipatory bail.
2. The learned counsel for the petitioner would submit that the petitioner has been arrayed as accused in this case based upon the confession of the coaccused and it is also the further submission of the learned counsel for the petitioner that the robbed property had been recovered.
3. However, the learned Government Advocate (Crl.side) appearing for the respondent would strongly oppose the anticipatory bail application on the ground that the petitioner has misused the liberty granted by this Court and there are about four previous cases against him. Inspite of obtaining bail on condition, he has been repeating the same offence. The said submission has got some force. Therefore, this Court is of the firm view that the petitioner does not deserve anticipatory bail.
4. Accordingly, this Criminal Original Petition is dismissed. 06.04.2026 dna
