ORDER

The petitioner apprehends arrest for the alleged offence under Sections 5 and 7 (3) of the Lotteries (Regulation) Act r/w. Section 318(4) of BNS in Crime No.128 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the respondent Police found A1 selling banned lottery tickets and conducting online lottery sales through mobile phone and Rs.57,040/- has been seized from A1. Hence, this case.

3. The learned counsel for the petitioner submitted based on the confession statement of the co-accused, he has been falsely implicated in this case. He further submitted that the petitioner is innocent and has been falsely implicated in this case. The petitioner is ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are three previous cases pending against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration of the nature of the allegation against the petitioner and upon fact that the petitioner has got three previous cases pending against him, the conduct of the petitioner in misusing the liberty by involving himself in similar offence, this Court is not inclined to enlarge the petitioner on anticipatory bail.

6. Accordingly, this Criminal Original Petition is dismissed. 06-04-2026 SHL To:
