This petition has been filed to direct the respondent to modify the condition imposed on the petitioners to furnish one of the surety as blood relative and instead to give cash surety Cr.M.P.No.3480 of 2015 dated 25.09.2015 on the file of the learned Session Judge, Tiruvannamalai.
2. Heard the learned counsel for the petitioners; learned Additional Public Prosecutor appearing for the respondent and perused the materials placed on record.
3. It is seen that, the petitioners were granted bail in Crl.M.P.No.3480 of 2015, on the following conditions: "Considering the nature and circumstances of the case, and also in view of fact that the investigation in this case is almost over and the petitioners/accused are under custody for more than 26 days, the court is of the considered view that the petitioners/accused shall be enlarged on bail on their executing a bond for a sum of Rs.5,000/- along with two sureties out of which one surety https://hcservices.ecourts.gov.in/hcservices/
shall be the blood relative of the petitioner to the satisfaction of the Judicial Magistrate, Polur, and also the original Identity Card of the 2nd petitioner, to be produced before the Judicial Magistrate concerned at the time of producing sureties and the same shall be retained by the court below to secure her presence in future.
After being released on bail, the petitioners/accused should appear before the respondent police daily at 10.00 a.m. until further ordres."
4. Considering the facts and circumstances of the case, this petition is dismissed, with liberty to the petitioner to approach the learned Sessions Judge, Tiruvannamalai for modification of the aforesaid conditions.
