ORDER
(Order of the Court was made SATISH K. AGNIHOTRI, J.) Mrs. A. Srijayanthi, learned Special Government Pleader, accepts notice for the respondents. With the consent of the learned counsel for the parties, the writ petition is taken up for final disposal, at the admission stage itself.
The petitioner is an agriculturalist of Rettamangalam Village, Uthiramerur Taluk, Kanchipuram District. Noticing that the present President and the former President of Rettamangalam Village Panchayat, in collusion with some individuals, have helped some real estate owners to grab Government poramboke lands such as tanks, channels, grazing grounds and Natham Poramboke land, worth several crores of rupees, besides seriously attempting to encroach upon grazing ground poramboke and tank poramboke to form a road, to help them to form a layout, the petitioner has addressed a representation https://hcservices.ecourts.gov.in/hcservices/
dated 7th January 2015 to the respondents, seeking removal of encroachment and also necessary action against the encroachers, erring Government officials and Panchayat President, who helped such encroachment. Since the said representation has not been acted upon by the respondents, the petitioner has come up with the instant writ petition seeking a mandamus to the respondents to dispose of his representation dated 7th January 2015.
Considering the limited scope of the relief sought by the petitioner, without going into the merits of the case, we direct the respondents to consider and pass orders on the petitioner's representation dated 7th January 2015 (except the request of the petitioner seeking removal of the Panchayat President) on its own merit and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. Needless to state that the alleged encroachers be given an opportunity of being heard before any coercive action is taken against them, if on enquiry, it comes to light that there exists such encroachment, as alleged by the petitioner.
With the above direction and observation, this writ petition stands disposed of. Costs made easy.
