Bakery and Tea Stall" situated at Katpadi to V.Kotta National Highway, Latteri, Katpadi Taluk, Vellore District up to 24 hours by considering the petitioner's representation dated 13.11.2012. The petitioner seeks for a direction to the third respondent to grant permission for running a tea stall in V.Kotta National Highway, Latteri, Katpadi Taluk, Vellore District for 24 hours to this effect, he has given a representation dated 13.11.2012.
2.Heard M.Rajendiran, learned counsel appearing for the petitioner and Mr.K.Balamurugan, learned Government Advocate appearing for the respondents.
3. The learned counsel appearing for the petitioner would submit that though he has obtained licence from Tamil Nadu Food https://hcservices.ecourts.gov.in/hcservices/
Safety and Drug Administration Department, the third respondent has been causing interference, by directing him to close the shop after 11.00 p.m.
4. On the other hand, Mr.K.Balamurugan, learned Government Advocate appearing for the respondents would submit that the petitioner does not possess a valid licence under Section 7 of the Tamil Nadu Shops and Establishments Act, 1947 and hence, he cannot be permitted to carry on his business after 11.00 p.m.
5. Under such circumstances, without going into the merits of the claim made by the petitioner in his representation as well as the affidavit filed in this writ petition, there shall be a direction to the third respondent to consider the petitioner's representation dated 13.11.2012 and pass orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
With the above direction, this writ petition is disposed of. No costs.
