Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the respondent dated 23.08.2018 and quash the same and further direct the respondent authority to grant due permission to conduct the cultural programme in Vinayagar Chathurthi Festival at Avarang Kattur Village, Pappireddipatti Taluk, Dharmapuri District on 14.09.2018. O R D E R

This petition has been filed to direct the respondent to give permission to the cultural programme to be held on 14.09.2018 in Vinayakar Chathurthi Festival at Avarang Kattur Village, Pappireddipatti Taluk, Dharmapuri District.

2. The learned counsel for the petitioner has submitted that in the village of Avarang Kattur, the people used to celebrate Vinayagar Chathurthi every year and this year also, they have decided to celebrate the festival on 14.09.2018 and during the said festival, some cultural programme also have to be held and for that purpose, the petitioner gave a representation to the respondent on 23.08.2018 seeking permission, but, so far no order has been passed . https://hcservices.ecourts.gov.in/hcservices/

3. The learned public prosecutor has submitted that there is a possibility for communal clashes and hence permission cannot be granted.

4. Admittedly, so far no case has been registered against any of the persons with regard to the cultural programme to be held in the said village. Therefore, the respondent is directed to consider the petitioner's representation and dispose of the same in accordance with law on or before 13.09.2018 and inform to the petitioner.

5. with the aforesaid submissions, this petition is disposed of . No costs.
