ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.02.2026 for the alleged offences under Section 274, 275, 123 of B.N.S., Sections 6 and 24(1) of COTPA and Section 77 of Juvenile Justice Act, 2015 and Section 7 read with 9(ii) of TNPSS Act, 2003 in Cr. No.344 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with A2 was found in illegal possession of 900 kgs of banned Tobacco products for sale and hence the case.

3. The learned counsel for the petitioner would submit that the petitioner was arrested and remanded to judicial custody on 16.02.2026 for the possession of 900 kgs of banned Tobacco products. He would further submit that the coaccused were released on bail and hence prayed to enlarge the petitioner on bail.

4. At this juncture, the learned Government Advocate (Criminal side) appearing for the respondent police would strongly object the bail application on the ground that this petitioner has 5 other previous cases of similar nature.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. The objection of the learned Government Advocate that the petitioner has 5 previous cases, would clearly demonstrate that the petitioner is a repeat offender and therefore, as rightly contended by the learned Government Advocate that if the petitioner is enlarged on bail, there is every likelihood of committing the offence once again. Hence, this Court is of the firm view that it is not an appropriate stage to consider this bail application.

7. Accordingly, this Criminal Original Petition is dismissed. 09-04-2026 MJS Note:
