The petitioners, who were arrested and remanded to judicial custody on 15.03.2024 in connection with Crime No.115 of 2024 registered for the offence punishable under Sections 273 & 328 of IPC and Sections 7(1), 20(2) of Cigarettes and other Tobacco Products Act, 2003, seek bail.
2. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are no way connected with the alleged offence and they have been suffering incarceration from 15.03.2024. He also submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court, hence he prayed for grant of bail to the petitioners.

Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection for granting bail to the petitioners stating that the accused were found to be in illegal possession of 1459 kilograms of banned tobacco products and its worth is about Rs.10,53,000/-. He further submitted that there are four accused in this case and the petitioners herein are arrayed as A1, A3 and A4. He also submitted that even though there is no previous case against these petitioners, if they released on bail, there is a possibility of them absconding and not available for the further investigation. 4. Heard both sides and perused the materials available on record.
5. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Crl.Side) and taking note of the fact that the investigation in this case is still pending and also considering the huge quantity of contraband seized from the accused, this Court is not inclined to grant bail to the petitioners.
