Prayer : Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to issue a direction to the VII Metropolitan Magistrate (FTC-III) at Saidapet, Chennai to dispose the proceedings in C.C.No.1105 of 2016 pending on its file, within a stipulated period fixed.

O R D E R

This petition has been filed by the complainant to issue a direction to the VII Metropolitan Magistrate (FTC-III) at Saidapet, Chennai to dispose of the case in C.C.No.1105 of 2016 at early.

2. The learned counsel for the petitioner has submitted that the petitioner herein has filed a private complaint under Section 138 of the Negotiable Instruments Act, and based on the said complaint, the learned VII Metropolitan Magistrate has taken the case on file in C.C.No.1105 of 2016 and issued summons https://hcservices.ecourts.gov.in/hcservices/

to the accused. The accused also appeared even in the year 2017. He further submitted that on 14.09.2017, P.W.1 was examined and thereafter, it was adjourned for cross-examination and till today, there is no progress and therefore, he prayed to direct the concerned Metropolitan Magistrate to expedite the trial and dispose of the aforesaid case at early.

3. The petitioner has enclosed a copy of the case status detail in the typed set of papers. A perusal of the same would show that the case was taken on file in the year 2016 and thereafter the accused appeared in the year 2017 and PW1 was examined in chief and from 14.09.2017, the case has been adjourned for cross examination of PW1. Hence, the concerned Metropolitan Magistrate is directed to expedite the trial and dispose of the aforesaid case within three months from the date of receipt of copy of this order.

4. With the aforesaid observations, this petition is disposed of. No costs.
