Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records relating letter dated 12.03.2024 on the file of 2nd respondent issued to the third respondent certifying that the certificate issued regarding the Crime Documents Record C & O Sheet No.315/2013 dated 11.11.2013, reporting that the certificate dated 12.11.2013 issued by K1 Sembium Police Station records not found in the Police Station and quash the same and direct the 2nd respondent to seek authenticity of C & O sheet 1/4

No.315/2013 dated 11.11.2013 from the 1st respondent with regard to the complaint lodged by the petitioner and with respect to the non-traceable certificate issued in letter No.K1/49 R.C.No.17030/PUB/CRB/2013, C & O Sheet No.315/2013 dated 11.11.2013 and issued the authenticity of the non traceable certificate Dated 12.11.2013 to the 3rd respondent enabling the petitioner to register Power of Attorney and other deeds pertained to his property at premises bearing Door No.46C, Madhavaram High Road, Moolakadai, Chennai - 600 060.

The Sub-Registrar, Madhavaram has sought for details of the non traceable certificate issued by the Sembium Police on 12.11.2013. The Inspector of Police attached to Sembium Police Station by letter dated 12.03.2024 had informed the Sub-Registrar, Madhavaram, that there is no records pertaining to the non-traceable certificate alleged to have been issued by the petitioner in letter No.K1/49 R.C.No.17030/PUB/CRB/2013, C & O Sheet No.315/2013 dated 11.11.2013. Being aggrieved, the present Writ Petition is filed seeking Certiorarified Mandamus.

2.The learned Government Advocate (Crl.Side) who took notice, on verification from the Crime Record Bureau have now found that there are details in the Crime Record Bureau a complaint of missing record and non-traceable certificate issued and therefore, based on the documents available in the Crime Record Bureau, appropriate communication be issued to the Sub Registrar, Madhavaram.

3.Recording the said undertaking, the Writ Petition is disposed of with a direction to the respondent Police to communicate to respond the Sub Registrar, Madhavaram, about the particulars available with the Crime Record Bureau regarding the complaint on missing document within a period of one week from the date of receipt of a copy of this order. Consequently, the connected Miscellaneous Petition is closed. No costs.
