Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.A.No.536 of 2020 on the file of the High Court, the High Court will be pleased to suspend the sentence made in Spl.C.C.No.10 of 2019 on the file of the Special court for Exclusive Trial of cases under POCSO Act, Coimbatore dated 18.02.2020 and enlarge on bail pending in the above Crl.A.536/2020 and pass such further or other orders Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.A.No.536 of 2020 on the file of the High Court and upon hearing the arguments of M/S.S.N.ARUNKUMAR, Advocate for the petitioner and of M/S.R.MUNIYAPPARAJ, Govt. Advocate (Crl side) on behalf of the Respondent the court made the following order:- (Order of the Court was made by P.N.PRAKASH,J.) This is the second bail petition.

2. It is seen that the petitioner, who was 23 years, had physical affair with the victim girl, who was 15 years, on account of which, she became pregnant and delivered a child. Thereafter, the petitioner got married to someone else and abandoned the victim girl. The DNA report clearly implicates the petitioner as the father of the child.

4. Under such circumstances, this is not a fit case to grant suspension of sentence and bail to the petitioner and accordingly, this criminal miscellaneous petition is dismissed.

However, the Registry is directed to call for the records, prepare the typed set of papers and post the main appeal for hearing in the second week for August.
