Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.M.SANJAIYAN, Advocate for the petitioner and of Mr.E.

RAJA, SPECIAL PUBLIC PROSECUTOR FOR (V & AC) on behalf of the Respondent the court made the following order:- The above petition is filed praying to modify the condition imposed upon the petitioner on 12.05.2016 in Crl.MP.No.5607 of 2016 in Crl.A.No.370 of 2016 to sign once in three months before the Chief Judicial Magistrate and Special Judge, Erode in Spl.C.C.No.2 of 2014, instead of every month, pending disposal of the above appeal in Crl.Appeal No.370 of 2016.

2. It is submitted by the learned counsel for the petitioner that due to the petitioner's age related ailments and also heart problem, he is not in a position to sign every month.

3. Learned Special Public Prosecutor appearing for the respondent submits that the petitioner has been complying with the conditions imposed by this court without any default.

4. In the circumstances, this court is inclined to modify the order dated 12.05.2016 passed in M.P.No.5607 of 2016 in Crl.A.No.370

of 2016. Accordingly, the petitioner shall appear before the learned Special Judge / Chief Judicial Magistrate, Erode at 10.30 a.m., on the first working day, once in three months, pending appeal. -sd/- 09/02/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
