Mr.R.Govindasamy, learned Special Government Pleader takes notice for respondents 1 o 3. By consent of both parties, the writ petition is taken up for disposal at the stage of admission itself.
2.The petitioner seeks for a mandamus to direct the respondents herein to survey and demarcate the boundary of
petitioner's land in Revenue Survey No.177/3 admeasuring an extent of 2.02 acres (0.82.0 hectares) situated at Navanari Village, Dharapuram Taluk, Tirupur District.
3. Heard both sides.
4. The grievance of the petitioner is that even though the petitioner has paid necessary charges to survey the subject property and made a representation followed by reminder dated 11.04.2019, till this date, the respondents have not conducted any survey.
5.This Court, at this stage, is not expressing any view on the survey of the subject matter property, as it is for the first and second respondents to consider and decide the same on its own merits and in accordance with law. Therefore, this writ petition is disposed of, only with a direction to the first and second respondents to consider the representation of the petitioner followed by a reminder dated 11.04.2019, seeking to survey and demarcate the boundaries of the subject property and pass orders on the same on merits and in accordance with law, after hearing all the parties concerned and the other rival claimants, if any. Such exercise shall be done by the respondent within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
