Order XIII-A of the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act 2015, prayed for (i) Directing the defendants one and two to pay a sum of Rs.2,17,29,824/- jointly and severally to plaintiff towards arrears of rent for the suit property from November 2008 to Mrch 2017 along with interest at the rate of 24% per annum on Rs.2,17,29,824/- from the date of plaint till the realization of the plaint.

(ii) Direct the defendants to pay the cost of the suit. For plaintiffs : Mr.L.Muralikrishnan For Defendants : Mr.S.Vijayaraghavan

JUDGMENT

The suit is filed by the plaintiff for recovery of money.

2. Pending suit, the plaintiffs and the defendants have entered into settlement and has drawn joint memo of compromise dated 28.04.2021.

3. Recording the settlement reported by the parties, the suit is 2/4

decreed in terms of joint memo of compromise. The terms of joint memo of compromise shall form part of the decree. Since the matter has been settled out of Court, the plaintiffs are entitled to get refund of full Court fee. Consequently, connected application is also closed.
