PRAYER : Criminal Original Petition filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, Act, 2023, to enlarge the petitioner on bail in crime No.545 of 2025 on the file of the respondent police. ORDER

The petitioner, who was arrested and remanded to judicial custody on 19.01.2026 for the alleged offence under Sections 331(3), 331(4) and 305(a) in Crime No.545 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner by house breaking stolen a sum of Rs.20,000/-, 5 sovereign of gold and one two wheeler bike. 1/4

Hence, the present case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case and that he has not committed any offence as alleged by the prosecution. He would further submit the petitioner has been in judicial custody since 19.01.2026 and he is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent Police strongly opposed the grant of bail to the petitioner on the ground that the petitioner has got 15 previous cases. Hence, he opposed the grant of bail to the petitioners.

From the submission of the learned Government Advocate, it is amply clear that the petitioner had a habit of committing similar offence and that, as and when he was released on bail, he has attempted to obstruct the course of justice by committing further offence. Therefore, as rightly contended by the learned Government Advocate that, if the petitioner is enlarged on bail, he will become threat to the society.

6. Taking into consideration of the totality circumstances of the case, and on the fact that if the petitioner is enlarged on bail, there is every possibility of committing the offence again, this Court is not inclined to grant bail to the petitioner.
