Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the Respondents to regularize the petitioner's service in the light of judgement dated 19.02.2021 in W.P. No.21440 of 2015 and batch, and consequently promote the petitioner as Clerk in the 4th Respondent Society. 2.This Writ Petition has been filed for issuance of a Writ of Mandamus directing the Respondents to regularize the petitioner's service in the light of judgement dated 19.02.2021 in W.P. No.21440 of 2015 and its batch and consequently promote the petitioner as Clerk in the 4th Respondent Society.
3.It is stated that the petitioner was appointed as Office Assistant on consolidated basis in the year 2000 and that he was promoted as Salesman and transferred to the 4th respondent Society on 26.10.2007. In the meanwhile, the petitioner completed Diploma in Co-operative Management and got additional qualification of certificate course in Jewel Appraisal and its Techniques and Diploma in Ms-Office. Though the petitioner was in service for more than 21 years, the petitioner's request for regularization of his service was not considered. The petitioner approached this Court and sought for issuing a positive direction to the respondents. 4.Learned counsel appearing for the petitioner states that the petitioner will be satisfied if a direction is issued to the second respondent to consider the petitioner's representation dated 24.06.2021.
5.Considering the limited scope of the prayer which is sought for in this Writ Petition, without expressing any opinion on the merits of the petitioner's representation, this writ petition is disposed of with a direction to the 2nd respondent to consider the representation of the petitioner dated 24.06.2021 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. No Costs. Consequently, connected miscellaneous petition is closed.
