ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offence under Section 379, 430 IPC., r/w Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.533 of 2021 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner was involved in illegal transportation of three units of river sand by using Tipper. Hence, the law enforcing agency registered a case against the petitioner.
3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prayed for anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor submitted that the petitioner has illegally transported three units of sand by using Tipper and hence he opposed to grant anticipatory bail to the petitioner.

5.This court is of the opinion that these types of cases are impacting large Magnitude and the petitioner is misusing the discretionary power of this Court and continues with the offences affecting the environment and ecology.
