This Original Petition has been filed under Section 372 of the Indian Succession Act XXXIX, 1925 read with Order XXV Rule 6 of the Madras High Court Original Side Rules, to grant succession certificate to the seventh petitioner namely B.Ethirajan with power to collect, to negotiate or transfer / transmission the securities specified in the schedule hereto standing in the name of the deceased A.Boopathy Nayagar. 2.The first petitioner is the son; second petitioner is the daughter-in-law; petitioners 3 and 4 are grandchildren; petitioners 5 and 6 are the daughters and petitioners 7 to 9 are the sons of the deceased A.Boopathy Nayagar. The deceased died on 25.12.2011. At the time of death, he left the assets mentioned in the schedule. Hence, the petitioners seeks succession certificate in favour of the seventh petitioner. 1/4
3.The seventh petitioner has examined himself as P.W.1 and marked 7 documents as Exs-P.1 to P.7. To prove the debenture certificates held by the deceased in Sriram Transport Finance Company Private Limited, Ex-P.1 is filed; Ex-P.2 (Series 2 Nos.) are the photocopies of the share certificates held by the deceased; Ex-P.3 is the death certificate of the deceased; Ex-P.4 is the legal heirship certificate of the deceased; Ex-P.6 is the death certificate of the husband of the second petitioner; Ex-P.7 is the paper publication. None has objected for grant of succession certificate in favour of the seventh petitioner.
4.The petitioners 1 to 6, 8 and 9 have have filed consent affidavits before this Court to issue succession certificate in favour of the seventh petitioner.
5.Considering the above, the petitioners have established their right and are entitled to succession certificate. 2/4
6.Accordingly, this Original Petition is ordered as prayed for and a direction for grant of Succession Certificate in favour of the seventh petitioner with power to collect, to negotiate or transfer / transmission the securities specified in the schedule standing in the name of the deceased A.Boopathy Nayagar, is issued.
