Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed in Crl.M.P.No.13786 of 2017 in Criminal Appeal No.492 of 2017 dated 07.11.2017 and pass such further or other orders.
[CRL.MP.NO.12024/2018] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of MR.S.HAROON ALI RASHEED M/S.T.S.GOPALAN AND CO Advocate for the petitioner and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- This petition has been filed to relax the bail condition imposed by this court in Crl.M.P.No.13786 of 2017 in Crl.A.No.492 of 2017 dated 07.11.2017 directing the petitioner to appear before the trial Court on every Monday at 10.30 a.m until further orders.
2. The learned counsel for the petitioner would submit that this Court while granting suspension of sentence imposed the condition that the petitioner has to appear before the learned XI Additional Special Judge for CBI cases, Chennai once in a month. The learned counsel for the petitioner would submit that the petitioner is a senior citizen and he is aged about 73 years and submit that the petitioner is a permanent resident of Vellore and every time, the petitioner to travel from Vellore to Chennai to comply with the condition has to be assisted and accompanied by his wife who is also a senior citizen and would submit that some leniency may be shown to him and that conditions may be modified that instead of appearing before the Trial Court every month he may be permitted to appear before once in three months.

3.The learned Special Public Prosecutor CBI cases would submit that the petitioner has been regularly complying with the condition from December 2017 to September 2018.
4.Taking into consideration the submission made by the learned counsel, the condition is modified to the effect that the petitioner shall appear before the Trial Court on the first working day, once in three months of every English calender Month at 10.30 A.M until further orders starting from the 1st working day of December 2018. -sd/- 14/09/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
