Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to appoint the petitioner as Village Assistant as per the Employment Seniority under the Land Priority Quota by considering the representation dated 6.1.2018 and followed the reminder dated 15.5.2018.

O R D E R

The relief sought for in the present writ petition is for a direction to direct the respondents to appoint the writ petitioner as Village Assistant as per the Employment Seniority under the Land Priority Quota by considering the representation submitted by the writ petitioner on 6.1.2018. https://hcservices.ecourts.gov.in/hcservices/

2. Appointment can never be claimed as a matter of legal right. All appointments are to be made strictly in accordance with the Recruitment Rules in force. If at all the writ petitioner is entitled to appoint under the Land Priority Quota, his case is to be considered in accordance with the seniority as well as based on the admissible quota as per the Rules in force.

3. Contrarily, the direction for appointment cannot be issued and the authorities competent have to consider the case of the writ petitioner, while undertaking the process of appointment and during the relevant point of time. When the process of appointment has been commenced, the cases of all the eligible persons coming under the category of Land Priority Quota are to be considered strictly in accordance with the seniority as well as by following the Rules in force.

4. With the above observations, the writ petition stands disposed of. However, there shall be no order as to costs.
