ORDER
The petitioner/accused, facing trial in C.C.No.427 of 2025 for offence under Sections 8(c), 20(b)(ii)(A) of Narcotic Drugs and Psychotropic Substances Act, 1985 (in short 'NDPS Act'), had filed this petition seeking a direction to the trial Court to expedite the proceedings in C.C.No.427 of 2025.
2.The contention of the learned counsel for petitioner is that a case was projected as though 800 grams of Ganja seized from the petitioner. The case was registered on 19.03.2023, charge sheet filed on 10.02.2025. Thereafter copies of charge sheet with annexures furnished in accordance with Section 207 of Cr.P.C. On perusal of charge sheet, it was found that copies of Forensic Science Laboratory Report and other documents mentioned in the charge sheet not furnished to the petitioner. Hence, the petitioner filed a petition under Section 207 of Cr.P.C. in Crl.M.P.No.558 of 2026, seeking to furnish copies of the same, which is pending before the trial Court. He further submitted that the petitioner is doing Post Graduate in M.B.A. and he was called for the Internship Fair. Due to the implication of this case, he could not further pursue his education.
3.The learned Additional Public Prosecutor submitted that there is no such other documents and it is only a typographical error. Today from the CD file, he handed over the copy of Forensic Science Laboratory Report to the learned counsel for petitioner, who acknowledged the same. 4.The objection of the learned counsel for petitioner is that the contraband was sent for chemical examination with considerable delay, but no explanation
given. The chain of custody is doubtful. Hence, for that purpose this document is necessary. It is a matter of fact which has to be decided during trial. Now Forensic Science Laboratory Report handed over to the petitioner, which has been endorsed by the counsel for petitioner. Now the petitioner obtained the desired relief sought for in Crl.M.P.No.558 of 2026. Recording the same, the trial Court to dispose of Crl.M.P.No.558 of 2026. The petitioner is directed to participate in the trial, there are only 7 witnesses and the trial can be completed within a stipulated period, preferably within a period of four months from the date of receipt of a copy of this order.
5.With the above observations, the Criminal Original Petition is disposed of.
