Respondents Prayer :- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents 1 to 4 to consider the petitioner's representation dated 09.10.2019 and thereby cancel the patta No.46 stands in the name of the 5th respondent in Surveny Nos.320/3, 320/13, 320/14, 324/5E, 343/2 situated at Thuramangalam Village, Perambalur Taluk, Perambalur District immediately on the light of proceedings of the 2nd respondent dated 22.10.2019 and consequently grant joint patta in the name of the petitioner and other legal heirs of late Angammal in respect of the above addressed properties.

ORDER

(1)This writ petition has been filed for the issue of a writ of mandamus, directing the 3rd respondent to consider the appeal filed by the petitioner on 09.10.2019, wherein the petitioner https://hcservices.ecourts.gov.in/hcservices/

has sought for the cancellation of the patta issued in favour of the 5th respondent.

(2)Mr.Annai Ezhil, learned Government Advocate accepting notice on behalf of the respondents 1 to 4 submitted that the appeal filed by the petitioner has been taken on file by the 3rd respondent and the enquiry has been fixed on 24.09.2020 at 11.00 a.m. The learned counsel submitted that the petitioner can be present for the enquiry with all necessary documents. (3)Taking into consideration the facts and circumstances of the case and also of the fact that the 3rd respondent has already fixed a date for enquiry, there shall be a direction to the 3rd respondent to the 3rd respondent to consider the appeal filed by the petitioner strictly in accordance with law and pass orders within a period of six weeks from the date of receipt of a copy of this order. The 3rd respondent shall issue notice to the 5th respondent and afford him an opportunity before conducting the enquiry and passing final orders. (4)This writ petition is disposed of with the above direction. No costs.
