(The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 11.08.2020 for the offences punishable under Sections 379 of IPC and 21(4) of Mines and Minerals (Developments and Regulation) Act, 1957, in Crime No. 1492 of 2020 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner was transporting two units of savudu sand illegally by using Tipper Lorry without any valid licence. Hence, the compliant. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner was found in illegal transportation of two units of sand by using Tipper Lorry. He would further submit that there are eight previous cases are pending against him in similar nature. Therefore, he vehemently opposed to grant bail to the petitioner.

Taking into consideration the facts and submissions made by the learned counsel and the fact that there are eight previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner for the present.
