Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records on the file of respondent order passed in Na.Ka.No.A4/2443/2021, dated 06.01.2022 rejecting the application for legal heir certificate filed by the petitioner and quash the same, and consequently direct the respondent to issue a Legal Heir Certificate of Sri.S.Satish Kumar including the name of the Petitioner as his son on the basis of the petitioner's application dated 23.09.2021.

ORDER

The petitioner herein is the adopted son of certain S.Sathis Kumar, who had adopted him after following customary rituals on 19.06.2012 and also registered the same on 23.12.2020. The said S.Sathis Kumar has now passed away and the petitioner seeks a legal heir certificate to that effect.

2.Mr.V.Manoharan, learned Additional Government Pleader appeared on behalf of the respondent and brought to the notice of the Court the proceedings of the Principle Secretary to Government in Letter No.9633/RA-3(2)/2022-4, Dated 28.09.2022, wherein he has provided that an adopted son is also eligible for obtaining a legal heir certificate. 3.The respondent is now required to follow the above said rule and consider the application of the petitioner for a legal heir certificate and dispose of the same within a period of eight (8) weeks from today. 2/4
