ORDER

The petitioner was issued with a charge memo on 23.1.2016 alleging misconduct in respect of seizure of a lorry, which was audited by the Sub Collector, Gobichettipalayam on 30.12.2014. On receipt of the charge memo, he has also submitted his explanation denying the charge on 10.2.2016. Adding further, the learned counsel for the petitioner submitted that the disciplinary authority, finding no satisfactory explanation, proceeded with the enquiry by appointing an enquiry officer on 10.3.2016 and thereafter the enquiry officer has examined some of the witnesses, but, till date, it has not come to an end. In the meanwhile, the petitioner is also losing the benefit of promotion. Therefore, as he is hopeful of establishing his innocence, since the charge levelled against him is without any basis, sought for immediate disposal of the pending disciplinary proceedings.

2. Mr.T.M.Pappiah, learned Special Government Pleader, taking notice on behalf of the first respondent, also sought for reasonable time to complete the disciplinary proceedings.

3. In view of the above, this Court hereby directs the first respondent to dispose of the disciplinary proceedings initiated against the petitioner, in accordance with law, within a period of three months from the date of receipt of a copy of this order.
