Mr.S.Muthusamy Govt.Advoacte Order This writ petition has been filed, challenging the impugned notice issued by the respondent stating that the petitioner's building has been unauthorisedly constructed.

2.The petitioner had applied for building sanction on 25.03.2026. Admittedly, the said application is yet to be considered by the respondent. Even prior to passing final orders on the petitioner's application seeking for building sanction, the impugned notice has been issued. 3.Mr.S.Muthusamy, learned Government Advocate accepts notice on behalf of the respondent.

4.No prejudice would be caused to the respondent if the petitioner's application seeking for building sanction is considered, on merits and in accordance with law, within a time frame to be fixed by this Court. 5.Only if the building of the petitioner is an unauthorised construction, the question of issuing the impugned notice will arise. 6.For the foregoing reasons, this writ petition is disposed of by directing the respondent to pass final orders, on merits and in accordance with law on the petitioner's application dated 25.03.2026, which has been filed as a document along with this writ petition by the petitioner, within a period of 4 weeks from the date of receipt of a copy of this order. In case the building constructed by the petitioner is found to be unauthorised, the respondent is granted liberty to proceed with the impugned notice dated 16.03.2026 against the petitioner and it

is made clear that only for a period of four weeks from the date of receipt of a copy of this order, a direction is issued to the respondent to keep the impugned notice dated 16.03.2026 in abeyance.
