Prayer: Appeal filed under Section 96 R/w Order 41 Rule 1 & 2 of Civil Procedure Code against the judgment and decree dated 28.02.1991 and made in O.S.303 of 89 on the file of the Principal Subordinate Judge, Cuddalore.

JUDGMENT
This appeal was transferred to this Court for being heard along with A.S.No.441 of 1991 by order dated 01.09.1997, made in Tr.CMP.No.13889 of 1992.
2. The Registry has reported that A.S.No.441 of 1991 has been withdrawn and was dismissed as withdrawn on 09.08.2004 itself. The appellant has so far not engaged any counsel. Therefore, I directed the Registry to print the name of Mr.R.Gururaj, learned counsel who had appeared before the lower Court namely, the Principal District Court, Cuddlaore.
3. When the matter is taken up for hearing, Mr.R.Gururaj, learned counsel reports that he has sent a letter to the party which has been returned with an endorsement "left" and he is unable to contact the appellant. Hence, I am of the view that no purpose would be served in keeping this appeal pending. Therefore, this appeal is dismissed for non-prosecution.
