O R D E R
(The case has been heard through video conference) The Writ Petition has been filed seeking a direction directing the 2nd respondent to dispose of the petitioner's application dated 28.04.2021 on the basis of recommendation of 1st respondent dated 17.05.2021.
2. According to the petitioner, his family owns the property in Survey No.58/3 & 4, situated in Avarapakkam village. Now, the petitioner's father and mother died. Subsequently, the petitioner had filed an application through her guardian for grant of patta in her name. At that time, they were informed that patta stands in the name of one Padmalakshmi instead of her parents name. In the said circumstances, the petitioner has made an application before the 3rd respondent seeking for transfer of patta in her name on 28.04.2021. Since no order has been passed, the petitioner has approached the 1st respondent District Collector to take suitable action and the 1st respondent by an order dated 07.05.2021 has directed the 3rd respondent Tahsildar to conduct enquiry and take suitable action on the petitioner's application. Despite that, the petitioner's application was not considered and no order has been passed in it. Hence, the present writ petition has been filed by the petitioner.
3. Mr.R.Karunagaran, learned counsel appearing for petitioner would submit that, the petitioner's application is pending with the 3rd respondent for a long time. Hence, the 3rd respondent may be directed to conduct enquiry and pass suitable orders within a time frame to be fixed by this Court.
4. Considering the limited prayer sought in the Writ Petition, without going into the merits of the case, the 3rd respondent is directed to consider the petitioner's application and to pass suitable orders on merits in accordance with law after hearing the petitioner through her guardian and also the said Padmalakshmi, whose name Patta stands as on today within a period of twelve weeks from the date of receipt of a copy of this order. Accordingly, this Writ Petition stands disposed of. No costs. Consequently, the connected Writ Miscellaneous Petition is closed.
