CMP No.10118 of 2020 in S.A.No.SR54228 of 2020 P.T.ASHA, J The above application is filed for condoning the delay of 171 days in filing the second appeal.

2.The respondent has entered appearance through counsel on 06.10.2020. Today, when the matter is listed, there is no representation on the side of the respondents.

3. In the affidavit filed in support of the petition, the plaintiff would submit that though the order copy was made available immediately i.e. on 12.12.2019, he was unable to go over to the counsel to collect the papers as he was unwell and further, there was shortage of funds. Thereafter, he had obtained the papers and collected the money for filing the second appeal. By which time, lockdown on account of pandemic have been enforced. 4. Considering the fact that sufficient reasons have been made for condoning the delay and accordingly, this petition is ordered and the delay of 171 days is condoned.

5. Registry is directed to number the appeal if it is otherwise in order.
