With consent on either side, the main Writ Petition itself is taken up for final disposal at the admission stage.

This Writ Petition has been filed to direct the respondents to regulate the play schools by bringing into force the Code of Regulations for Play schools under the Tamilnadu Private Schools (Regulation) Act, 2018 and Rules, 2023 and a comprehensive regulatory framework governing Play Schools, with appropriate binding effect based on the representation of the petitioner dated 27.01.2026.

The learned counsel appearing for the petitioner would submit that the petitioner-association made a representation on 27.01.2026 to regulate the play schools by bringing in force the code of regulation for play schools under Tamilnadu Private Schools (Regulation) Act, 2018 and Rules, 2023 and a comprehensive regulatory frame work governing the play schools, however, the said representation has not yet considered and hence the present Writ Petition is filed.

The learned Special Government Pleader appearing for the respondent would submit that the play schools are also governed under the provisions of the Tamilnadu Private Schools (Regulation) Act,2018 and Rules, 2023 and a comprehensive regulatory framework thereunder, if any individual is running without proper facility or without recognition, the petitioner can individually make a representation as against the particular private school, however, in general, the petitioner made a complaint, as if there is no regulation available, is not correct, already there is a comprehensive regulatory framework governing play schools. There is appropriate rule for taking action for irregular private school, hence the grievance of the petitioner is misconceived, thereby pleaded to dismiss the Writ Petition.

5. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the entire documents placed on record.

It is relevant to note that petitioner-association made a representation on 27.01.2026 to regulate the play schools by bringing in force the regulation under Tamil Nadu Private School Regulation Act, 2018 and comprehensive related frame work governing the play schools, on the other hand, the respondents would contend that if any individual is running the play school /

private school without proper facility or without any recognition, the petitioner can individually make a representation as against the particular play / private school, further, in general, the petitioner made a complaint as if there is no regulation available, is not correct.

Considering the above said facts and circumstances of the case and taking note of the submissions made on either sides and the fact that there is Tamilnadu Private School Regulation Act, 2018 and Rules, 2023 and a comprehensive regulatory frame work governing the play schools and since the petitioner made a representation in general, the petitioner is at liberty make a fresh representation as against the particular private / play school, which is running contrary to the Tamilnadu Private School Regulation Act, 2018 and Rules, 2023 and a comprehensive regulatory frame work. With the above observations, the present Writ Petition is disposed of. No costs.
