This application has been filed by the applicant / plaintiff seeking leave to sue with respect of the Schedule B, C and D properties which are situated outside the jurisdiction of this Court.

2. The suit has been filed by the applicant / plaintiff for passing a preliminary decree declaring that the plaintiff is entitled to 1/4th share in the suit schedule properties and to appoint an Advocate Commissioner to divide the property by metes and bounds in terms of the preliminary decree and pass a final decree by allotting the share.

3. According to the learned counsel for the applicant / plaintiff, the suit has been filed for passing a preliminary decree against the defendants. Even though the cause of action is well within the jurisdiction of this Court, Schedule B, C and D of the suit schedule mentioned properties are situated outside the jurisdiction of this Court. Hence, this leave application is filed.
