Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 5 to survey the petitioner's land as per the patta and other related documents in the Cholamadevi revenue Patta No.3471, S.No.53/7, 0.7 Ares (17.1/4 cents) based on the representation dated 08.04.2021 and 23.06.2021 given by the petitioner to the 4th respondent herein.

ORDER

This Writ Petition has been filed in the nature of Mandamus seeking direction against the 1st to 5th respondents to survey the land of the petitioner in accordance with the patta and other documents in revenue Patta No.3471, S.No.53/7, 0.7 ares (17.1/4 cents) based on the representations dated 08.04.2021 and 23.06.2021 given by the petitioner to the 4th respondent namely, the Tahsildar, Jayankondam, Ariyalur District.

In the affidavit filed in support of the said petition, the affiant had stated that he had purchased the land and registered the Sale Deed in the Office of the Sub-Registrar, T.Palur, as document No.382/2021. He had also obtained a patta in Patta No.3471. He had given a representation and had also paid necessary charges for survey of the land. Since no action had been taken by the Tasildhar, the present Writ Petition has been filed seeking a direction to act on the representations made on 08.04.2021 and again on 23.06.2021.

3. In view of the limited relief sought, a direction is given to the 4th respondent to consider the representations dated 08.04.2021 and 23.06.2021 given by the petitioner. The 4th respondent may also issue notice to the 6th and 7th respondents namely, Kaliyamoorthi, S/o.Arumugam, residing at Colony Street, Amirtharayankottai Village, Cholamadevi Posts, Udayar Palayam Taluk, Ariyalur District and also to Sundaramoorthy S/o.Rasu, residing in the same address and thereafter, hear the petitioner and also the said respondents and pass a considered order with respect to the decision taken to survey the lands or not. The said exercise may be conducted within a period of 12 weeks from the date of receipt of a copy of this order by the 4th respondent.

4. With the above observations, the Writ Petition is disposed of. No costs.
