ORDER
This Criminal Miscellaneous Petition has been filed seeking suspension of sentence, consequent to the conviction of the petitioner, along with another accused, for the offence under Section 304(ii) IPC read with Section 299 IPC.
2. The petitioner (A2), along with A1, was charged for the offences under Sections 120(B), 304 and 34 IPC. Upon perusal of the records, the documents marked as exhibits, and the depositions of witnesses during both Chief examination and Cross-examination, the Trial Court came to the conclusion that the offences under Section 302 read with Section 34 IPC and Section 120(B) IPC were not made out. However, the Trial Court held that the death of the deceased had occurred due to negligence, thereby attracting the offence under Section 304(ii) IPC.
3. Prima facie the Trial Court has arrived at its conclusion based on the materials available on record and the evidence adduced. This Court does not find that the petitioner has made out a fair or strong case for succeeding in the appeal.
4. Therefore, this Criminal Miscellaneous Petition seeking suspension of sentence is liable to be dismissed and, accordingly, stands dismissed.
